Master Subscription Agreement

1. Scope

This Master Subscription Agreement (the “Agreement”) is between Palomar Data Systems (“PDS”) and the organization on whose behalf it is accepted (the “Customer”). It governs Customer's access to Recon and to the cultivation reporting PDS provides.

2. Acceptance

This Agreement takes effect when a person clicks “I agree” or ticks an equivalent checkbox. No signature is required. The person accepting represents that they have authority to bind their employer, and that employer becomes the Customer under this Agreement.

3. Documents incorporated by reference

The Website Terms of Use and the Privacy Policy are incorporated into this Agreement by reference. Where this Agreement conflicts with either of them, this Agreement controls.

4. Changes

PDS may revise this Agreement and the documents it incorporates. Revisions are effective when posted at these URLs, and continued use of Recon after posting constitutes acceptance of them. PDS records which version was in force at the time of each acceptance.

5. Customer data

Cultivation data remains the Customer's. PDS reads it to produce the reports and dashboards the Customer has asked for, and does not sell it.

6. Access

Access to Recon is per named individual and is not transferable. The Customer is responsible for telling PDS when someone should no longer have access.

7. Term and termination

This Agreement runs for as long as the Customer has an active subscription, and either party may end it in accordance with the subscription's own terms.
